General conditions of sale for Alexis Rosso training courses
Designation
Alexis Rosso trainer, located at 29 rue de Fontarabie – 75020 Paris, declared under number 11755611175 with the prefect of Île-de-France,
SIRET 519 029 862 00025.
Alexis Rosso designs, develops and delivers training in different places, training rooms or at the client intra or inter, throughout France and the DOM-TOM as well as the countries of the European Union and Africa.
These courses are qualifying.
In the following paragraphs, it is agreed to designate by:
-customer: any natural or legal person who registers or places an order with Alexis Rosso.
-trainee/student: the natural person who participates in a training course.
-OPCA: joint collection organizations approved and responsible for collecting and managing the training effort of companies.
Object
These general conditions of sale apply to all training services undertaken by Alexis Rosso on behalf of a client.
The fact of registering or placing an order, in particular by sending a registration form or an information sheet, implies full and unreserved acceptance by the signatory of these general conditions of sale.
These general conditions of sale prevail over any other document of the customer, and in particular over all the conditions of purchase of the customer.
The trainee/student also acknowledges that, prior to any registration, he has received sufficient information and advice from his employer or Alexis Rosso, enabling him to ensure that the training program is appropriate to his needs.
Financial conditions, regulations and terms of payment
All prices are indicated in euros and net, because Alexis Rosso is not subject to VAT.
The client agrees to pay Alexis Rosso the amount corresponding to the duration of the training in the event of partial or total non-financial support by the OPCA. The conditions will be to be seen on site with Alexis Rosso. In the absence of payment, the trainee/student will be excluded from the training.
In the event of support by the OPCA or a funding body, it is up to the client to send the documents required by Alexis Rosso for the monitoring and payment of training costs.
Withdrawal and replacement of a participant
In the event of withdrawal by the beneficiary less than fifteen (15) clear days before the start of one of the actions, or abandonment during training by one or more trainees, the training organization will deduct from the total cost, the sums he will have actually spent and/or committed to carrying out the action.
Cancellation, absence or interruption of training
Any module started is due in full and will be billed to the customer by Alexis Rosso. Absences not justified by a medical certificate will remain due, no possibility of recovering days of absence will be granted for any reason whatsoever.
On the other hand, in the event of cancellation of training for groups by the client, Alexis Rosso reserves the right to invoice the client for cancellation fees calculated as follows:
-if cancellation more than 15 working days before the training: no cancellation fees.
-if cancellation between 15 days and 7 working days before the training: the cancellation costs are equal to 50% of the price of the training.
-if cancellation less than 7 working days before the training: the cancellation costs are equal to 100% of the price of the training.
Opening hours and reception
Unless otherwise indicated on the invitation, Alexis Rosso welcomes trainees/students from 9 a.m. to 5 p.m.
Effective and adjournment
To promote the best learning conditions, the size of each course is limited to 10 people (maximum). The issuance of an estimate does not take the place of registration.
Once the number is reached, registrations are closed. Alexis Rosso can then propose to participate in a later session. In the event that the number of participants is insufficient to ensure the smooth running of the training, Alexis Rosso reserves the right to postpone it.
Agreement and certificate
For each training action, a training agreement is established between Alexis Rosso, the OPCA and/or the client. At the end of the training, Alexis Rosso gives a certificate of follow-up and end of training to the trainee/student.
Obligations and Force Majeure
As part of its training services, Alexis Rosso is bound by an obligation of teaching and not of results vis-à-vis its clients or trainees/students.
Alexis Rosso cannot be held responsible with regard to its clients or its trainees/students in the event of the non-performance of its obligations resulting from a fortuitous event or force majeure. The following are considered here as fortuitous events or cases of force majeure, in addition to those usually recognized by case law: the illness or accident of a speaker or an educational manager, strikes or social conflicts external to Alexis Rosso, natural disasters, fire, interruption of telecommunications, energy supply, or transport of any type, or any other circumstance beyond the reasonable control of Alexis Rosso.
Intellectual property
All of the presentation sheets, content and educational materials in whatever form (paper, electronic, digital, oral, etc.) used by Alexis Rosso to provide training or given to trainees/students constitute works protected by intellectual property.
As such, the client and the trainee are prohibited from using, transmitting, reproducing, exploiting or transforming all or part of these documents, without the express agreement of Alexis Rosso.
Description and training program
The contents of the programs, as they appear on the presentation sheets, are provided for information only. The speaker or the educational manager reserves the right to modify them according to current events, the level of the participants or the dynamics of the group.
Confidentiality and communication
Alexis Rosso, the client and the trainee/student undertake to keep confidential the documents and information to which they may have access during the course of the training or during the exchanges that took place prior to registration, in particular the all the elements that appear in the proposal sent by Alexis Rosso to the client.
Alexis Rosso undertakes not to communicate to third parties other than the partners with whom the training courses are organized and to the OPCAs, the information transmitted by the client, including information concerning the trainees/students. However, the client agrees to be quoted by Alexis Rosso as a client of his training. To this end, the client authorizes Alexis Rosso to mention his name as well as an objective description of the nature of the services in his lists of references and proposals for the attention of his prospects and his customers, interviews with third parties, reports of activity, as well as in the event of legal, regulatory or accounting provisions requiring it.
Protection and access to personal information
The client undertakes to inform each trainee/student that:
- personal data concerning him are collected and processed for the purposes of monitoring the validation of the training and improving the Alexis Rosso offer.
- in accordance with the law n°78-17 of January 6, 1978, the trainee has a right of access, modification, rectification of the personal data concerning him.
In particular, Alexis Rosso will keep the data related to the course and the evaluation of the trainee student achievements, for a period not exceeding the duration necessary for the assessment of the training.
Applicable law and competent jurisdiction
The general conditions detailed in this document are governed by French law. In the event of a dispute arising between the client and Alexis Rosso on the occasion of the interpretation of these presents or the execution of the contract, an amicable solution will be sought. Otherwise, the courts of Paris will have sole jurisdiction to settle the dispute.
